Terms of Service

M-Track is a construction and interior-project operations platform operated by a sole proprietorship registered in India ("M-Track", "we", "us"). By creating an account or using the service (the "Service") you ("you", "the customer") agree to these Terms of Service ("Terms") and to our Privacy Policy.

M-Track provides a hosted web + mobile application for managing construction and interior projects — tasks, quotations, orders, approvals, meetings, attendance, chat, files, status tracking, and related workflows. We may add, modify or discontinue features from time to time; where the change is material we'll notify you at least 30 days in advance.

You are responsible for keeping your login credentials secure and for all activity under your account. You must not share your credentials, attempt to circumvent the Service's access controls, or use another person's account without their permission. You must be at least 18 years old (or the age of majority where you live) to open an account.

Each subscription is for a single organisation. You may create multiple projects and invite unlimited users under one subscription, but you may not sub-license or resell access to the Service.

Access to the Service is offered as a paid subscription (see the Pricing page for current plans and rates). All fees are quoted in Indian Rupees and are inclusive or exclusive of GST as shown at checkout; invoices are generated automatically and hosted in your account.

Subscriptions renew automatically at the end of each billing period at the then-current published rate unless you cancel from your account settings before renewal. We may change our published rates at any time; the new rate applies from your next renewal, never the current period.

Every paid subscription includes a 15-day trial from the date of purchase. If you cancel within the trial window we will refund the amount charged in full. Full refund terms are described in our Refund Policy.

The data you upload to M-Track — projects, tasks, quotations, files, chat, attendance and everything else your team creates — remains yours. We process it only to provide and improve the Service, in line with our Privacy Policy.

You are responsible for the accuracy of the data you enter and for ensuring you have the right to upload it (for example, that vendor or client information is shared with their consent). You must not upload content that is illegal, that infringes on someone else's rights, or that contains malicious code.

You agree not to:

• Reverse-engineer, scrape, or attempt to gain unauthorised access to any part of the Service.
• Use the Service to send spam, phishing, or unsolicited commercial content.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to build a directly competing product.

Violation of this section may result in suspension or termination of your account without a refund.

M-Track (including the software, design, brand, and content we author) is our property or that of our licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the Service for your organisation's internal purposes during your paid subscription. Nothing in these Terms transfers ownership of our IP to you.

You can cancel your subscription at any time from within the app; your access continues until the end of the paid period. We may suspend or terminate your account for non-payment, for violating these Terms, or if the law requires us to. Where a termination isn't your fault we'll refund the unused portion of your current billing period.

On termination we'll keep your data for at least 30 days so you can export it; after that it is deleted per our Privacy Policy's retention section.

The Service is provided "as is" without any warranty beyond what is required by applicable law. To the extent permitted by law our aggregate liability under these Terms is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.

We may update these Terms from time to time. If the change is material we'll notify you by email and in the app at least 30 days before it takes effect; if you continue to use the Service after the change takes effect you accept the new Terms.
